Federal Court Mandates Release of Abrego Garcia from Immigration Detention

Courtroom proceedings

A court has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.

"Since his release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.

The situation stems from a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer alien smuggling charges, he was held in federal custody.

In her order, the judge pointed out that the government lacks a valid deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Case

The court proceedings involve conflicting assertions. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the smuggling charges, which are part of a ongoing criminal case in the state of Tennessee.

Terms of Release

The judge, who was hearing his petition to removal in a federal court, ruled that he must now comply with the terms of his bond from jail in Tennessee. This decision effectively transfers his supervision to the Tennessee court.

This decision marks a significant turn in a complicated legal battle featuring claims of wrongful detention and contested criminal associations.
